1. Acceptance of Terms

Welcome to Princara Watersports (“Company”, “we”, “our”, or “us”).

By booking, purchasing, or participating in any of our activities, including but not limited to jet ski rentals, parasailing, banana boat rides, or any other water-based experiences, you agree to be bound by these Terms of Service.

If you do not agree to these Terms, you should not use our services.

2. Eligibility

By participating in our activities, you represent and warrant that:

• You meet the minimum age requirements for the selected activity
• You are physically and medically fit to participate
• You will follow all safety instructions provided by our staff
• If booking on behalf of others, you have authority to agree to these Terms on their behalf

Minors must have parental or legal guardian consent and supervision where required.

3. Bookings and Payments

All bookings are subject to availability.

• Full or partial payment may be required to confirm a reservation
• Prices are listed in USD unless otherwise specified
• We reserve the right to modify pricing at any time prior to confirmation

Failure to arrive at the scheduled time may result in cancellation without refund.

4. Cancellation and Refund Policy

You are eligible for a 100% refund if you cancel at least 24 hours in advance.

Cancellations made between 12 and 24 hours prior to the scheduled activity are eligible for a 50% refund.

Cancellations made within 12 hours of the scheduled activity, as well as no-shows, are non-refundable.

5. Safety and Conduct

Your safety is our priority. Participants must:

• Attend safety briefings before participating
• Wear required safety equipment
• Follow all staff instructions at all times
• Refrain from participating under the influence of alcohol or drugs

We reserve the right to refuse service to anyone who fails to comply with safety requirements, without refund.

6. Assumption of Risk and Liability Waiver

Water sports activities involve inherent risks, including but not limited to injury, property damage, or death.

By participating, you acknowledge and voluntarily assume all risks associated with such activities.

To the fullest extent permitted by Mexican law, Princara Watersports, its owners, employees, and affiliates shall not be liable for any direct, indirect, incidental, or consequential damages arising from participation in our services, except in cases of gross negligence or willful misconduct.

Participants may be required to sign a separate liability waiver before engaging in activities.

7. Medical Conditions

You agree to disclose any medical condition that may affect your ability to safely participate.

We reserve the right to deny participation if we believe a medical condition may pose a safety risk.

8. Weather and Operational Conditions

All activities are subject to weather, sea conditions, and operational considerations.

We reserve the right to delay, modify, or cancel activities due to safety concerns.

9. Damage and Equipment Responsibility

Participants are responsible for any damage caused to equipment due to negligence, misuse, or failure to follow instructions.

Repair or replacement costs may be charged accordingly.

10. Intellectual Property

All content on our website, including logos, text, images, and branding, is the property of Princara Watersports and may not be used without prior written consent.

11. Privacy

Your use of our services is also governed by our Privacy Policy.

12. Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of Mexico.

Any disputes arising out of or relating to these Terms shall be subject to the jurisdiction of the competent courts of Quintana Roo, Mexico.

13. Modifications to Terms

We reserve the right to update or modify these Terms of Service at any time. Updated versions will be posted on our website with a revised effective date.
